Petitioner has questioned the validity of Annexure P-4 dated 06.10.2016 of Board of Governors (BOG), NIPER, SAS Nagar, Mohali. In the instant writ petition, petitioner has not arrayed the persons likely to be affected if Annexure P-4 is set aside.

 

Learned counsel for the petitioner submitted that he would restrict his prayer challenged to Annexure P-4 insofar as Item No. 2, 11 and 21. The petitioner is permitted to implead names of the persons which are reflected at Item No. 2 and 21 during the course of day. Appointing as member ex-officio and member at Item Nos. 2, 11 and 21 are contrary to Section 13 of the National Institute of Pharmaceutical Education and Research Act, 1998.

Operation of Annexure P-4 insofar as nomination at Item No.2-Professor K.K.Bhutani, Item No. 11-Representative of Pharmacy Council of India (PCI) and Item No. 21 Wing Commander PJP Singh Waraich as Secretary, are stayed till the next date of hearing.
