Power of Officiating director; matter of perception or rule?

Statutes  says "Senate recommends degree to Board for conferment."  Question remains can Officiating director,

1. Reconstitute Senate without consulting Board when Board of Governors is in place and active?


2. Confer degree without consulting Board when Board of Governors is in place and active? 


Competent authority should clarify.

An email circulated to NIPER Board, faculty & staff members few days back along with copy of RTI response attached with the email. Text of the email is as follows.......


As per RTI information, Her Excellency visitor of NIPER has given the approval which is reproduced as: “The president, in her capacity as the visitor of NIPER, S.A.S. Nagar, Mohali has been pleased to approve the proposals contained in para 3 of the Department of Pharmaceutical I.D. Note No. 51013/7/2009-NIPER dated 23.12.2009 on the subject (Acceptance of resignation submitted by Prof. P. RamaRao, Director, NIPER, S.A.S. Nagar, Mohali and alternative arrangement in his place till the selection of new regular Director)

 The ministry order is reproduced as “Dr. K.K.Bhulani, Head of Department of Natural Products, NlPER, would officiate as Director, NIPER, Mohali, till such time regular Director, NIPER Mohali, is appointed”. Thus it is very clear that this appointment was done as per NIPER Act/statutes. There is no mentioned about the power and tenure of officiating director in the NIPER Act/Statutes; however it is clear cut mentioned that the tenure of alternative arrangement in place of regular director cannot be exceeding more than one year.

In absence of any time line in the order, NIPER statutes will prevails. It is for sure, honorable visitor approval was taken as per requirement of NIPER act/statutes.

On the same issue, Shri Arun Jha has also mentioned for his understanding about the powers/responsibility in his letter dated 23.09.2011 which is reproduced as:

Shri Arun Jha further stated that he has been given to understand that recruitment rules for the post of the Director which were approved by the BOG in 1995 have not been notified in the Gazette and also not followed in the past by NIPER Mohali ".

It is pertinent to note “Who has given this understanding the recruitment rules for the post of director is not followed by NIPER Mohali????”

Again in para 54.16, point No. 4 at page 11,

I had remarked that I have been given to understand that the officiating director has full powers like a regular director. Therefore in the 6th line of this point No. 4 at page No. 11 "I have been given to understand that” should be, added before officiating Director. 


It is pertinent to note “Who has given this understanding that officiating director has full powers like a regular director????”
