Subject: appeal against illegal appointment and joining of Prof. Ramarao at C. U. P., Bathinda.

Respected Sir/Madam,
In attachment is the documents which prove that appointment and joining of prof. Ramarao at CUP, bathinda is illegal.

Following are the important facts in documents:

1) NIPER BOG formed on 6th on Dec 2006 for three years, Thus for all the non ex-offitio members term is over on 6th of dec 2009 including Chairman.

2) After resignation Ramarao applied to Pujab Central University on 26th of Dec 2009

3) He claimed that he applied through proper channel and Chairman BOG forwarded his application on 28th Dec 2009

4) He joined punjab Central university from 1st Jan 2010

Now Ramarao's appointment is illegal, Because

1) a BoG chairman whose term expires on 6th Dec 2009 how can he forward his application on 28th of Dec

2) When is the interview happened? How many candidates were there?

3) is not it a violation of Article 14 and 16 of Constitution and

Supreme court Judgment CIVIL APPEAL NO. 1272 OF 2011 Para 19 of the judgment CIVIL APPEAL NO. 1272 OF 2011, “Therefore, it is a settled legal proposition that no person can be appointed even on a temporary or ad hoc basis without inviting applications from all eligible candidates. If any appointment is made by merely inviting names from the Employment Exchange or putting a note on the Notice Board etc. that will not meet the requirement of Articles 14 and 16 of the Constitution. Such a course violates the mandates of Articles 14 and 16 of the Constitution of India as it deprives the candidates who are eligible for the post, from being considered. A person employed in violation of these provisions is not entitled to any relief including salary. For a valid and legal appointment mandatory compliance of the said Constitutional requirement is to be fulfilled. The equality clause enshrined in Article 16 requires that every such appointment be made by an open advertisement as to enable all eligible persons to compete on merit.”

Is bleak placement record of NIPER Mohali because of average marking?


The bleak placement record raised many eyebrows in the recent BOG meeting. It is also became point of agony to the many concern. Now the question is why is so? Why an institute of National importance after spending more then 400 crore of taxpayer money failed to place the students in respectable jobs?

CAG pointed out shoddy state of education @NIPER, "NIPER was established by Govt. of India as a center of excellence for imparting higher education research and development in pharmaceutical science and management. Thus it requires skilled staff for smooth running of teaching activities. The sanctioned strength was fixed in the year 1994.  As on 31 March 2011, the sanctioned strength of the staff in different cadres was 279, but the staff in position there for work was 165 only . Thus 144 posts in different cadres were lying vacant.


The following information may be furnished to audit:-

Reasons for not filling the vacant posts through the intake of students had increased by 66.82 percent compared to year 2009-10 may be intimated.


The manner in which NIPER was imparting education to the students in the absence of adequate staff may be intimated."

Answer to the CAG question is learnt recently, students were awarded average marks at least in two occasion without proper classes or training (imparting that type of education to the students does not require adequate staff),

When asked about the average marking Deputy Registrar, Academics & Examination (DR, A&E) NIPER replied, "There was no such provision of average marking in the NIPER statutes"

When there was no provision and you ((DR, A&E) was responsible for following all the laid down rules of the statutes then on what basis average marks were given to the students?

Deputy Registrar, Academics & Examination (DR, A&E) NIPER replied,"Director had constituted a sub committee  of Senate members ............ The Sub committee had recommended that the average marks should be given" 

When the same question about Senate sub committee asked to another Senate member Dr. Neeraj kumar, Dr. kumar replied that " The members were informed there was a Senate sub committee which had decided to award marks on average basis...."

He further stated that in his knowledge this Senate sub committee had never been formed in the Senate. He added that he was not agreeable to awarding average marks and as a senate member, gave his written dissent note.

Dr. Kumar also mentioned that as far as he remembered Dr. B. B. Tandon also mentioned that the award of average marks should not be the way, because it would set a wrong precedence and all others members were in agreement to this.  He further stated that this was only the verbal statement by Dr. Tandon and he did not submit any written note if dissent.

The alleged sub committee meeting never took place to give average marking. When asked to Professor C. S. Dey HOD Biotechnology about the meeting. Prof. Dey, replied that he was not able to recall. However, he stated that it was unlikely that such a meeting would have been held without his participation.”

When asked about the Senate sub committee formation, Prof Dey replied that he did not recall to have received the order of formation of such sub committee.

Knowing that the practice harming students future, all most all faculty members decided to keep mum about it. The person protested it, is victimized.

In several occasion Dr. Roy represented verbally as well as in written communication to competent authority that

“I do not want to associate my self with students who have not completed all the liabilities of 1st semester because of following ethical reason. At the end when the student will apply for any position in academia or industry, I have to write recommendation. In that recommendation I have to mention clearly whether they have completed all the liabilities of the course along with various skills they acquired during the course.   Since the present batch did not complete full course, part of their curriculum remain incomplete. Knowing that I will not be able to lie to national and or international scientific community.

Bleak placement record of NIPER Mohali raises many question

The Department of Pharmaceuticals has envisaged an investment Rs 3,000 crore to set up ten more National Institute of Pharmaceutical Education and Research (NIPER) over the next five years in to enhance availability of skilled human resources in the pharma sector.

The proposal to set up ten additional NIPERs is one of the many proposals, worth Rs 12,280 crore, that have been submitted to the Planning Commission by the Department of Pharmaceuticals (DoP) under the 12th Five Year Plan.

Enhance availability of skilled man power?  The placement record appended tells a very different story. It is learnt that the following placement record raised many eyebrows in the recent BOG meeting. Corruption in NIPER is wide spread and gone beyond NIPER. CAG warning fallen into deaf ear; CAG unearthed shoddy state of education @NIPER


Money spent on construction of many white elephants and unused facilities Laboratory space crunch deprive students to get hands on training for which NIPER was famous once upon a time.  In an average 30% is placed what happened to majority? Per capita expenditure is much more compared to any university (UIPS?) With this placement record do we really need more.................?

Staff (non-teaching) Promotion Scheme @NIPER send to cold storage

Damocles’ sword has been kept hanging on  the head of NIPER Staff by putting a vague agenda item in BOG (9th Jan, 2012) by the institute which does not specify any time frame for providing any benefit to staff members in terms of promotion (Promotion is only reserved to chosen few).

It is relevant to mention here that many staff members has already put in more than ten years of service and deserves not only ‘reassurance’ of continued service but also due recognition for his/her hard and sincere research efforts which have brought the institute national and international recognition.


Submission to BOG
"Subsequent to implementation  of sixth Central Pay Commission, an institutional committee was constituted to review the existing Personal Promotion Scheme on 28.01.2010. The committee had several meetings and drafted a revised Personal Promotion Scheme/Policy. The employees of the Institute have also been asked to provide their suggestions on the draft of revised Personal Promotion Scheme. Numerous Suggestions have been received from the employees. However, the committee is yet to give final recommendations on the revised Personal Promotion Scheme. It is further reported that two of the committee members i.e. Sh. Bhupinder Singh DR (F&A) and Sh K. L. Singla DR (A&P) have since left the institute hence the committee is to be reconstituted. Once the Committee submits the report, it shall be placed before the BOG for consideration and decision." 


It is also reported that

"However it is reported that there are two main hinderance in finalization of the policy
1. Contract system
2. Regularization of 107 temporary post



This is highly discriminatory, derogatory and threatening because few staff members have already been informed that ‘contract’ is under abolition since BOG has recommended the same in its 52nd & 53rd meeting and recommendations are pending with ministry for notification. Thus, in the same Institute, on the same issue, two different decisions are being communicated to BOG

 "....posts are regular and are Non-Plan posts."

52.14 To consider removal of contract system of recruitment of employee of the Institute.

The details with respect to nature of present posts in the NIPER, S.A.S. Nagar was discussed in the meeting and it was informed by the representative of the ministry that the posts are regular and are Non-Plan posts. The NIPER informed the Board that Academic Planning & Development Committee (APDC) of the Institute has also recommended that Contract System could be done away with.


THE BOARD of the Governors accepted the recommendation of APDC and resolved that the removal of the contract system of the recruitment of the employee of the Institute be approved with the appropriate amendments in the act and Statutes of the Institute.

B Majority of the problems in the Institute are related to contractual appointments against the permanent posts. As a result, there is a sense of insecurity in the mind of the incumbents. He further emphasized that the decision of the Board taken in the 52nd Meeting held on 29th August, 2009 w.r.t. abolition of the contract system of recruitment of employees in the institute be implemented as soon as possible, with appropriate amendments in the act and statutes of the institute.

University Suspects Fraud by Dr. Dipak Das, University of Connecticut

* A charge of widespread scientific fraud, involving 26 articles published in 11 journals, was leveled by the University of Connecticut today against Dipak K. Das, one of its researchers, whose work reported health benefits in red wine.
* Das won the “Albrecht Fleckenstein Memorial Award for distinguished work in the field of Basic Research” (INNOVATION Award??)  last year. 
* Dr. Das “defunded” the work of a researcher from his budget saying she was devoting all of her time to another researcher, who turns out to be the informant or “whistle-blower” (whistle-blowers are victim everywhere).
* The University of Connecticut said Wednesday that it was returning two new grants to Dr. Das, worth a total of $890,000, to the federal government. (I wish we had the smiler  strong administrator)
*Das has apparently been relieved of his duties as editor in chief of Antioxidants & Redox Signaling. (here we reward the person
*According to a 60-page summary of the report, Dr. Das’s published research articles were found to contain 145 instances of fabrication and falsification of data.

After Pharma elits, academicians also abandoning NIPER


Corruption and misdeeds are all time high @NIPER by GANG OF FOUR. So high that elites are declined to be associated with NIPER.

Dr. Tushar Kanti Chakraborty, FNA, FASc, FNASc. Director, Central Drug Research Institute (CDRI), Lucknowdeclined to be member of the Board of Governors, NIPER.

Instrument worth Crores is Students responsibility @NIPER

Theft of costly research instruments/ furnitures etc are taking place at NIPER Mohali regularly, but none were reported to police. What is depicted here is only tip of the iceberg; detail audit, inspection and verification may recover more skeletons from the cupboard.

1. Theft of one equipment from Dept. of Pharmaceutics cost 1,94,033 reported but no action were taken. After RTI inquiry started.

2. In the file noting Finance officer noted “As per Gov of India General Finance Rule 34 (GFR-2005) all loses theft etc exceeding Rs 10000 shall be reported to the police for investigation at the earliest.”

3. The financial loss incurred needs to be recovered immediately and an enquiry committee consisting of Dean HOD ORG and AR (purchase) should look into and place their report by July 2010” Director

The committee submitted report on 02.09.2011(though officiating Director asked by July 2010). Extract of the report are as follows;

B.  "This is a case of theft not of misplacement but it could not be established as who has stolen the probe [accessories of ultrasonic processor 220V-Cat. No 04712-81]


C. "As a similar probe of a similar ultrasonic processor  in the department of Biotechnology is also reported to be missing therefore possibility of making the loss good by Biotechnology department by stealing the probe of Pharmaceutics department could not be established"

Thank God!! Ultrasonic probe of Biotechnology is also missing. Otherwise committee could have established that it was stolen by Biotechnology faculty.


D. "The committee also noted that the Ultrasonic processor of Pharmaceutics Deptt. was purchased against DST project, undertaken by the institute. The NIPER is custodian of all assets purchased under the project"

E. "The committee also observed that recoveries in respect of the loss could not be effected from any body despite orders of the director dated 29.06.2010 "

Submission to the Board


" The matter is reported to the Board of Governors as it is the competent authority in which is vested the rights to write of the item. Although the primary responsibility was that of the students, as at the time of loss, the probe was in the physical custody of the students who spent last day in the institute on 30.06.2011. Dr. Sanyog Jain and head, Department of Pharmaceutics could not be held responsible for delay in reporting as they had very little knowledge of CCS/ GFR rules to deal such issues. Still their endeavored to trace the probe and fix the responsibility to the best of their knowledge. The senior administrative officer i.e Officiating Registrar and Deputy Registrar who could have handled the matter more diligently using their expertise are no more in the service of the Institute"


Few questions Herr..........;

1. " primary responsibility was that of the students" Equipments are primary responsibility of Students?

2. Then what is the responsibility of faculty? Attending consultancy projects for personal gain?

3. Why inquiry committee made report after more then one year of Director's order?

4. Ignorance of rules or deliberate act of hiding? Why nothing is started till an RTI is filed?

5. What about Probe of Biotechnology? Whose responsibility was that?

6. Under cluse; DST can take back equipments purchased in the project, if DST asks back the equipment what will be the answer?

7. Who knows what other instruments are missing from other departments? Physical verification is not done in proper manner since inception of NIPER. CAG pointed out that in several reports.


Finally 

8. The TEM purchased utilizing four and half crore in another DST project is UNDER who's responsibility Herr ....(who wrote the submission to BOG)?
