It is to inform you that the
constitution of the Board of Governors was challenged before the Hon’ble Punjab
and Haryana High Court in the CWP 22655 of 2016 which was disposed of vide
order dated 08/12/2016 consequent upon the making of the statement by the
counsel for the respondent therein that the Constitution of the Board of
Governors has been withdrawn. As such, you were required to renotify the
constitution of the Board of Governors by incorporating all the incumbents as
mandatorily required to be incorporated in terms of Section 4 (3) of the NIPER
Act, 1998 including that of the Members of Parliament. But without
reconstitution and renotification of the Board of Governors, all of you hold
its meeting on 27/12/2016 and then on 15/03/2017 and now is proposed to be held
on 07/05/2017. This act on your part amounts to contempt of the Honourable
Court.
On being pointed out in COCP No. 1018 of
2017, the Hon’ble High Court has already issued notice to all of you on
21/04/2017. Through this communication, the aforesaid development is brought to
your notice. As such no steps be taken to hold the meeting of the Board of
Governors on 08/05/2017. Otherwise, it would amount to gross contempt on your
part.
