Chronological list of events leading to Suspension, Inquiry, Dismissal etc. as Dr. Roy narrated with supporting documents
Dec 2009 Prof. K. K. Bhutani called me in his office in Natural products
department in presence of Prof. Rahul Jain and told me that Prof. P. Ramarao
then Director, has constituted two inquiry committees against me on 17th
Dec 2009 and he is the chairman of both of them. Though he did not understand what
are the charges but it is related to Brussels visit and the director is pressurizing
him to take action against me. He
will get the files soon and can let me know what are the charges. His non-verbal
communication and gesture seems suspicious to me and I told him in clear voice
I have not done any thing wrong and nor afraid to face any inquiry committee
when ever it was conducted.
Feb 2010 In the beginning of Feb 2010 Prof. K. K. Bhutani re constituted cafeteria
committee and made me chairman along
with Dr. Vipin Nair, Mr. Hardeep singh and Mr. Promod kumar and instructed me
that the present condition of cafeteria is not good in terms of food quality
and price and the present contractor Mr. Ramesh chand is not paying the
electricity bill and creating trouble in morning and evening teatime in
research block he need to go and some good people should be put into the job.
As per his instruction I have conducted the old and new cafeteria committee
meeting on 17th Feb 2010 and tried to solve the problem with talking
with the contractor. During the meeting then acting registrar and old cafeteria
committee member Mr. Bhupinder singh told us it will be illegal to remove
Ramesh chand in the middle of contract period and the price for food was the
lowest when the contract is awarded. We prepared the minutes as discussed and
the draft minute was send to Director for approval. As a corrective measure of
food quality served in cafeteria two contributory faculty dinners was arranged
and Ramesh chand was also put in the Job of Spandan dinner. All faculty members
approved the quality of food served in cafeteria. However Prof K.K. Bhutani was not happy in these
developments and he called all cafeteria committee members and showed his displeasure.
March 2010 Prof. K. K. Bhutani again called me
in director’s office in administrative building and told me to forget about the
communication we had in December in his HOD office as there is no committees
actually formed and Prof. Ramarao is gone. He also told me that Cafeteria need
to be run by good people like his attendant. Some of his words reproduced
below,
“However
I would like to take your help in various matters and be prepare to take
responsibility. Do not be so headstrong. Honesty is not always useful in
administration. Spitting on the road is illegal but how many people in India
follow that?”
Though I did not understood fully what
actually meant but I chose not to argue with him. After few days (29.03.10)
officiating registrars office order was circulated and my name was in six
different committees.
April –Aug,10 It is well known that in NIPER Mohali, all democratic functions are
stage-managed at the instance of a coterie, but as a member of these committees
I have carried out policy changes as a result of which a substantial saving of
around Rs 40 lacs per year was made in the purchase of diesel and Rs 70 lakhs
approx in ad-hoc purchase of spare parts for costly and sophisticated Lab
equipments. Besides this I also convinced the other committees members to make
payments to contract workers through Bank, which has led to not only saving for
the NIPER but also in reduction of the 'Ghost' workers. One can imagine to the
total amount involved in such scams in the NIPER, which has been in existence
since 1995.
During this period I was called by Dr K K
Bhutani, officiating Director several times, insisting that I should rewrite all the minutes of these
committees as per their verbal instructions. They informed me that other
members of these committees have been persuaded to sign on the dotted line.
Unfortunately, I refused, not knowing my zeal for upholding professional and
social values would lead me to the present situation, where I am humiliated not
in the scientific community but also in the eyes of my near dear ones as well
as to face financial crisis.
02.09.10 On 2nd Sep 2010 morning I have
received a letter delivered enigmatically under my office door. The letter was
written by NIPER unidentified stuff members to Visitor of this institute. The
letter painted me as a tented officer and mentioned that an “active case of financial embezzlement” is
pending against me and also pointing that I am involved in funneling money to Shri
Latli Kumar Jain, Ex BOG Member and Chairman SMPIC as a standing purchase committee
two (SPCII) member.
03.09.10 Matter was communicated to
Director, NIPER in writing mentioning the letter and clearly depicting the
concern about reputation as reproduced below,
I have been labeled as a tainted officer, in this letter, and leveled
with charges that an “active case of financial embezzlement” is pending against
me. However I have never received any official communications for last nine
years regarding this or any other financial irregularity from NIPER authorities.
In case there is anything else on record or in my personal file due to
which it is felt there is ‘taint’ on me, it may please be communicated to me at
the earliest, preferably within 10 days. I wish to have it on record from you
to defend my reputation and integrity.
07.09.10 Matter was communicated to
chairman and Convener SPC II in writing mentioning the letter and clearly
depicting the concern about on “triangular caucus involving SPCII” as reproduced below,
I have been labeled as a tainted officer, in this letter, and leveled
with charges that “Shri Roy now
virtually runs the purchase committee from where a conduit has been create to
pass on the money to Shri Lalit Kumar Jain, with Director NIPER’s protection.
Already huge sum of money has been funneled out from these development funds
through this triangular caucus consisting of Director, Shri Nilanjan Roy and
Shri Lalit Kumrt Jain.”
Though other purchase committee members like Chairman, AR (A&P),
F&AO etc are not mentioned in that letter, it is obvious that either they
are involved or afraid of the “triangular caucus”.
What ever may be the case; I wish to have it discussed in the committee
in absence of myself, individual members view on this letter to be recorded and
forwarded to competent authority for further action. I have already
communicated this to Director NIPER vide Diary No 02 on 03/09/10 to defend my
reputation and integrity.

On 4th Dec 2010 Saturday Prof. Rahul
Jain told me that he has heard from somebody in administration that because of
my RTI activity the Brussels TA/DA case is again being framed. Next Monday, I
got a letter from F&AO NIPER and asked to clarify my position regarding the
TA/DA advance payment. I submitted all the paper regarding the case I had and
realizing that it could be the “active
case of financial embezzlement” mentioned in the letter. I also send a mail
to NIFA members in anticipation of “Beginning
of an witch hunting season”
06.12.10 Since I
have already mentioned the matter to SPCII committee I have forwarded the mail
to all the members to clarify the matter. Subsequently I have explained to them
in next meeting.

indicating Prof. K. K. Bhutani misused officiating director’s power to dissolve

09.02.01 Three members of Senate, NIPER namely Dr(s). Anand sharma, Nilanjan Roy
and Neeraj Kumar, meet Director NIPER on appointment and submitted a demand for
calling a requisition meeting of senate as per statutory provisions to discus,
“Violation of NIPER statutes and
ordinance by present Dean”. Prof Saranjeet Singh was violating NIPER
guiding principles as laid down in Act Statutes and Ordinance for last two and
half years and it out busted and created a email communication topic of Dr. Neeraj
Kumar, Dr. Parikshit Bansal, Prof. KPR Kartha and Professor Saranjeet Singh and
Dr. Nilanjan Roy in previous week.

NIPER on the subject matter as reproduced below, Recruitment of medical officer for NIPER dispensary by violating the
mandates of Articles 14 and 16 of the Constitution of India. Requesting him for canceling the
appointment and recovering the remunerations given to the medical officer.

28.3.11 Keeping in view the revengeful attitude of the Director, I wrote a letter to the President of India through proper channel. In response, i received a letter from the Officiating Director No. NIPER/DIR/2011/538 dated 29.3.11 clarifying that: “…the ministry vide letter No. 50020/21/2010-NIPER dated 18.3.2011 has asked me as the officiating Director to initiate action in this regard. The issuance of charge sheet against you is the result of directions from the Ministry. Thus, there is no substance of your allegation of vengeance act on my part.”

Thus bear perusal of the facts indicates that these allegations are framed because of personal vengeance. Competent authority did not feel to respond a written appeal for five months (Sep 2010 till Feb 2011). However only slapped it onto a face of a whistle blower with mala fide intention of hiding officiating directors own misdeeds and also the misdeeds of Dean NIPER. As an honest, upright, government official, with impeccable integrity and ethics I strongly feel that an impartial, judicious and magnanimous inquiry committee should be formed and look into the matter.
