Subject: appeal against illegal appointment and joining of Prof. Ramarao at C. U. P., Bathinda.

Respected Sir/Madam,
In attachment is the documents which prove that appointment and joining of prof. Ramarao at CUP, bathinda is illegal.

Following are the important facts in documents:

1) NIPER BOG formed on 6th on Dec 2006 for three years, Thus for all the non ex-offitio members term is over on 6th of dec 2009 including Chairman.

2) After resignation Ramarao applied to Pujab Central University on 26th of Dec 2009

3) He claimed that he applied through proper channel and Chairman BOG forwarded his application on 28th Dec 2009

4) He joined punjab Central university from 1st Jan 2010

Now Ramarao's appointment is illegal, Because

1) a BoG chairman whose term expires on 6th Dec 2009 how can he forward his application on 28th of Dec

2) When is the interview happened? How many candidates were there?

3) is not it a violation of Article 14 and 16 of Constitution and

Supreme court Judgment CIVIL APPEAL NO. 1272 OF 2011 Para 19 of the judgment CIVIL APPEAL NO. 1272 OF 2011, “Therefore, it is a settled legal proposition that no person can be appointed even on a temporary or ad hoc basis without inviting applications from all eligible candidates. If any appointment is made by merely inviting names from the Employment Exchange or putting a note on the Notice Board etc. that will not meet the requirement of Articles 14 and 16 of the Constitution. Such a course violates the mandates of Articles 14 and 16 of the Constitution of India as it deprives the candidates who are eligible for the post, from being considered. A person employed in violation of these provisions is not entitled to any relief including salary. For a valid and legal appointment mandatory compliance of the said Constitutional requirement is to be fulfilled. The equality clause enshrined in Article 16 requires that every such appointment be made by an open advertisement as to enable all eligible persons to compete on merit.”
