"GANG OF FOUR" Causing Irreparable Damage of NIPER, Mohali


After Pharmaceutical Nanotechnology another non performing assate of NIPER Technology Development Center (TDC) established in  year 2004, fail to fulfill entrustment of the Government. A reporte published in PHARMABIZ.com on April 30 2012 said so,

DoP moots National Centre for R&D in bulk drugs for helping sector

Department of Pharmaceuticals (DoP) is planning to set up a National Centre for R&D in bulk drugs with a total cost of Rs.56 crore. The move is in view of the rising competition to the Indian bulk drug industry especially from China affecting the viability of several small units.

As per the plans, the centre may be located at the National Institute of Pharmaceutical Education and Research (NIPER), Hyderabad, taking into account the large number of bulk drug players in Andhra Pradesh which accounted for 30 per cent of the sector, sources said.


WHY?? 
         TDC AT NIPER, Mohali USED AS MILKING COW, NOTHING ELSE

The National Institute of Pharmaceutical Education and Research set up a Technology Development Center (TDC) in the year 2004. The pilot plant and machinery commissioned in June 2004. Since 2004 the NIPER had been providing services of plant and machinery installed in the TDC to M/S Ranbaxy Laboratory Private Limited without fulfilling the National objective.

CAG (DPC Act 1971) Audit and inspection report on the account of NIPER for the year 2010-11 obtained by RTI. Relevant extracts irregularity para 3 are as under:
NIPER worked out monthly expenses for running and maintenance to Rs. 12.60 for the period from 15th july 2008 to 14th July 2009 against which the usage charge were fixed 14.85 per month. (for a 15 crore facility only 2.25 lakh per month income?)

 Scrutiny in audit revealed that while preparing the cost sheet depreciation on cost of plant and machinery was charged at 10% since 2004 where as the depreciation on plant and machinery was provided at 15% in the annual accounts of the NIPER. This resulted in under estimate of cost by Rs. 15.56 lakh during 2010 only.

How much NIPER lost since 2004 till 2009? GOD only knows. Were everybody @NIPER BLIND?  At least one person was not. He pointed out anomalies in 15.10.10 long before the CAG did.

CAG (DPC Act 1971) Audit and inspection report again pointed out that "The RANBXY delayed the release of payment of usage charge of Rs. 1.37 crore fro the period 15th July 2010 to 31st March 2011 and the payment was actually received by the NIPER on 18th April 2011 for which reason were not on record."  

Simple CAG dude, if interest of 1.37 crore is distributed, how it will be put on record?

It is also not in record that NIPER was providing manpower for running TDC since 2004. Though RANBAXY in the MOU clearly mentioned that "Ranbaxy will only utilize and pay for plant and machinery not manpower" 


Then why manpower was provided by NIPER? That too 31 in number? Whereas teaching departments are suffocating for manpower? Obviously for vested interest of someone involved with TDC. If somebody is milking the cow, the milk is consumed by somebody naturally.

As per audit cost calculation is wrong, thus the money paid by Ranbaxy is less then running charge who is paying for that? The answer is non plan budget of NIPER and IEBR fund.


Amount over and above non-plan is extracted from IEBR, which is intended to use for research and teaching. Thus who is starving for the expense of feeding the milking cow? 


Obviously NIPER teaching and research Program.






Finally what is the recommendation of CAG? 


"Reasons for not exporting the possibility for the use of TDC for contract research development, 
less charging of depreciation in cost sheet, 
delay in respect of payment from the Ranbaxy and loss of Interest thereto, 
lack of adequate publicity for the marketing of the facilities in the TDC and 
not framing training modules for use of TDC facility by its students 


may be intimated to audit."

Nepotism case two of Officiating director, current Registrar @NIPER not worthy of the post

 Wing Cdr PJP Singh Waraich (Retd.) does not meet the requisite qualifications of eligibility for the post of Registrar at NIPER, Mohali. Officiating Director made his selection deliberately though officiating Director was not competent authority to approve the appointment of registrar. This act of officiating Director amounts to ‘denial of opportunity’ to genuinely deserving candidates besides leading to ‘nepotism’.

For the post of the registrar many candidates, who were qualifying the required criteria applied, including acting registrar of NIPER. It is pertinent to mention that officiating director did not call the acting registrar, NIPER for the interview. The comparison of Dr. Shyam Narayan Dy. Registrar IIT Roorkee who attended the interview with PJP Singh Waraich is as under 

Registrar: Post -01: (unreserved): A person who shall be responsible for administration of the Institute on the policy guidelines set up by the Director and the Board of Governors.   The Registrar is expected to be a person with positive attitude, capable of problem solving and with a proven ability to coordinate the work of various wings such as Administration, Finance & Accounts, Examination, Engineering and Stores & Purchase.

Another milking cow @NIPER in making??

Cost escalation of construction is a routine feature @NIPER. 






Building cost of Technology development Center (formulation) escalated from 60 lakhs to 11 crore. Originally it was proposed to be a Schedule H compliance demo plant to show SME what is suppose to be done to be Schedule H compliant. At the letter stage it is converted a milking cow project and now it is being built to rent to again a specific company (RANBAXY may be).




After 11 crore it became another pigeon shelter, there is no money for furniture or equipments Department of Pharmaceuticals, Ministry of Chemicals and Fertilizers declined to provide more funding. Even if it is furnished and equipped as planed who will use it?


NIPER still lacks a decent size lecture hall, multiple of which is immediately needed.

Officiating Director @NIPER Quo warranto?


Appended mail was circulated amongst faculty members of NIPER and copy of the mail also send to Chairman BOG on 04th Nov, 2011. 


As per NIPER Statutes clause 14-Table-1 (r)  Visitor, The President of India and appointing authority of Director NIPER can only give appointment to officiating director for one year not more then that. 


Current officiating director started office on 01.01.2010 thus his term was over on 01.01 2011.  After that he is clinging to the chair illegally? 

OMG, I can't believe!! 
If it is really so, then lots of things are at stake, 
1. payments made by him to various vendors and service providers, 
2. degree awarded in the fifth convocation, 
3. appointments, 
4. promotion etc........

Dear faculty colleagues.

I wish to bring the information to your knowledge that current officiating director did not shown the letter of his appoint as it was his duty specifically when BOG was not in place and his appointment was done on the basis of the senior faculty teaching. This was also hear-say to us as order was not circulated. Right now I bring the information in your notice through NIPER Statutes clause 14-Table-1 (r) (Power, duties and function of Director) which reproduced as   
It clearly states that any extension of Director cannot be more than one year and lesser than one year as may be specified in the direction of visitor.   

Looking to all this, in the knowledge of all faculties and Chairman, BOG, I request to Registrar, NIPER to show the letter of extension to all employees of NIPER where he has been issued/appointed the officiating directorship since January 2010 and after January-2011. I am also sending the copy to Chairman, BOG for the same for which we have right to know that current officiating director is appointed legally. For this purpose, I have sleeked the information through RTI from ministry as well as from NIPER.

Arvind Saklani, Senior Group Leader at Piramal Life Sciences, Mumbai, worked at NIPER for three years as Assistant Professor, and left the institute in 2007, before his contract finished. Talking to The Indian Express, he said, "I had joined NIPER with a dream of great scientific research, but my experience was really bitter. Because of some people in the senior faculty, the institute has deteriorated much. Somebody else takes the credit for your research, and you have to compromise with your work, your ethics," said Saklani

It was, however, pointed out by the Director that, based on the background of Dr U.C.Banerjee, it would be better that Dr Banerjee is made Professor in the Department of Biotechnology rather than Pharmaceutical Technology. This was agreed to. 

Prof. Harkishen Singh raised a point regarding making Dr Banerjee, Professor and Head of the Department of Biotechnology. The Director felt that it will be desirable to see the working of Dr Banerjee for a couple of years before he is appointed as Head of the Department.

Wise visionary anticipated something? However Dr. Banerjee became HOD eventually



MINUTES OF THE 40TH MEETING OF THE BOARD OF GOVERNORS HELD ON 27-11-2003

40.7 TO CONSIDER APPOINTMENT OF DR U.C.BANERJEE AS HEAD OF THE DEPARTMENT, PHARMACEUTICAL TECHNOLOGY.

Approved.

After being HOD he started tormenting juniors, who was not subscribing his way of doing science. Dr. Animesh Roy started protesting and the matter got nasty. Though Dr.  Roy was a good scientist and the first patent granted to NIPER was authored by him, this HOD successfully scuttled his career to hide own act of plagiarism. After plenty of personal effort of Dr. Roy BOG made a committee to look into the matter. 



The Board of Governors in its meeting held on 17th December 2008 has approved the constitution of the following Committee to review the case of Dr. Animesh Roy, Ex-Scientist, NIPER, SAS Nagar and suggest the remedial measures.
1. Prof. Ramesh Chandra
2. Prof. Harmanjit Singh Hira
3. Dean, NIPER or his nominee
4. Representative of DCPC, Min. of Chem. & Fertilizers 
5. Representative of Dr. Animesh Roy, Ex-Scientist, NIPER, SAS Nagar


Terms of Reference:
1. To review the case of Dr. Animesh Roy, Ex-Scientist, NIPER, SAS Nagar and suggest the remedial measures.
2. The Committee is required to submit its report on or before 31st January, 2009 to the Chairman, BOG.


The above said notification no. F-1-15(13)2008/RGO/979 was issued by the Director, NIPER on dated 22-12-2008.


After combing through piles of paper and lots of witnesses the committee concluded

However, the current officiating director rewarded  the HOD with deanship (to propagate plagiarism amongst students?)

After two and half years of the committee decision and after six years of termination; Dr. Roy is reinstated in NIPER from 1st September 2011

Caveat: if BOG reinstate him retrospectively and NIPER have to pay him salary for six years (without any work) who should pay?

Five Professors responsible for wrongful termination?

Registrar post @NIPER is not approved by Ministry of Finance


MINUTES OF THE 37TH MEETING OF BOARD OF GOVERNORS OF NIPER
The 37th meeting of Board of Governors of NIPER was held on 4th October, 2002 at 2.00 p.m. in Conference Room No.118, Anusandhan Bhawan, 2 Rafi Marg, New Delhi under the Chairmanship of Dr R.A.Mashelkar, Director General, CSIR, New Delhi. The list of participants is enclosed. Leave of absence was granted to the members who could not attend the meeting.


AGENDA ITEM NO. 6 APPROVAL FOR APPOINTMENT OF REGISTRAR.

The Director NIPER explained in details the selection process for the post of Registrar. It was pointed out that since the post of Registrar has not yet been approved by the Ministry of Finance, it may not be in order to consider the appointment of Registrar.

However, the Chairman ruled that since Registrar has been appointed at an earlier occasion, this time also the appointment of Registrar can be considered against the vacant post of equal or higher rank.

Dr C.L.Kaul, Director NIPER also brought out that the candidate recommended for appointment i.e. Sh. Subrata Sarkar will be taken on deputation for a period of 2 years only. The BOG considered the proposal and approved the appointment of Sh. Subrata Sarkar as Registrar, NIPER at a basic pay of Rs.16400/- in the pay scale of Rs.16400-450-20900-500-22400/- on deputation for a period of two years.

Caveat: Post is still not approved by Ministry of Finance

MINUTES OF 31ST MEETING OF BOARD OF GOVERNORS OF NIPER HELD ON 24/10/2000 AT 11.30 HOURS UNDER THE CHAIRMANSHIP OF DR R.A.ASHELKAR, DIRECTOR-GENERAL, NEW DELHI.

The 31st meeting of Board of Governors of NIPER was held on 24th October, 2000 at 11.30 hours in the Conference Room of NIPER, S.A.S.Nagar (Mohali) under the Chairmanship of Dr R.A.Mashelkar, Director-General, Council of Scientific & Industrial Research, New Delhi.

Dr R.A.Mashelkar, Chairman, Board of Governors while welcoming all the members to the 31st meeting observed that the attendance for this meeting was rather thin. He felt that there was a need for the participation of members not only from the field of Education, Research but also from industries, as their guidance will be very useful for the Institute. It was also felt that the date for the next meeting may be finalized immediately so that sufficient notice for the meeting can be given to all the members sufficiently in advance.

Misappropriation of 607.26 lakh @NIPER due to violation of BOG direction.


Despite of clear direction from BoG, NIPER administration decided not to follow a time table for preparation and submission of Annual Accounts, so that finds can be diverted at will

Approved. However, for future guidance the Ministry representative requested NIPER to follow a time table for preparation and submission of Annual Accounts as under:-

1.     Appointment of Chartered Accountant -31st March every year.
2.    Compilation/finalization of accounts by the Institute-30th June every year.
3.    Accounts are to be certified by the Internal Auditors of the Institute by July Every year.
4.    Forwarding of the approved statement of account to AG, Punjab for audit/certificate within15 days on receipt from Internal Auditor of the Institute.
5.    Presentation of BOG for approval - in the first meeting to be held after receipt of audit report and certificate from AG, Punjab. 
6.    Hindi translation/printing of statement of accounts - within one month of approval of BOG. 
7.    Sending the Statement of Accounts to Ministry- within 15 days of the printing of report. 
8.    Forwarding of the Statement of Accounts by the Ministry to the Lok Sabha/Rajya Sabha Secretariat for laying – During session within 15 days of receipt of Statement of Accounts from the Institute, During Inter-Session - immediately at the start of the session.

However these steps were never followed leading to Loss/ misappropriation of 607.26 lakh Exchequer money during the year 2009-10 alone.
